1. Agreement to these terms
By accessing or using the Datok website, application, and related services (collectively, the “Service”), you agree to these Terms & Conditions. If your organization has a separate written agreement with Datok, that agreement controls to the extent of a conflict. Please do not use the Service if you do not agree to these terms.
2. The Service
Datok helps organizations connect marketing, advertising, analytics, affiliate, and ecommerce sources; retain and normalize reporting data; calculate business metrics; and present dashboards, reports, alerts, and analytical insights. Features may change as the Service develops.
Datok provides analytical tools, not legal, tax, accounting, or financial advice. You remain responsible for business decisions and for validating data against relevant source systems when accuracy is critical.
3. Accounts and organization access
You must provide accurate account information, protect your sign-in credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless caused by Datok's breach of these terms.
Organization administrators control membership, roles, connected sources, and access to organization data. You may use the Service only for organizations and data you are authorized to access.
4. Third-party services and Google authorization
The Service can connect to third-party platforms at your direction. You authorize Datok to access and process information from those platforms only to provide the connected features you select. Your use of each third-party platform remains subject to that provider's terms and policies.
Google sign-in is used to authenticate your identity. Connections to Google Analytics, Google Ads, and Search Console are separate, optional authorization flows that request applicable read-only access. You may disconnect a source in Datok or revoke access through your Google Account. Datok is not responsible for third-party outages, API changes, account restrictions, or data supplied by those services.
5. Your data and permissions
As between you and Datok, you retain your rights in the data you or your connected services provide. You grant Datok a limited right to host, copy, transform, transmit, and display that data only as needed to provide, secure, support, and improve the Service and to comply with law.
You confirm that you have all permissions necessary to provide and connect the data. Our handling of personal information is described in the Privacy Policy.
6. Acceptable use
You must not:
- use the Service or connected data unlawfully or without authorization;
- attempt to bypass access controls or probe another organization's data;
- introduce malware or interfere with Service availability or integrity;
- reverse engineer the Service except where law expressly permits it;
- use automated means that impose an unreasonable load on the Service;
- misrepresent Datok output or use it to violate a third party's rights; or
- resell or sublicense the Service without written permission.
7. Datok intellectual property
Datok and its licensors own the Service, including its software, visual design, documentation, and trademarks. Subject to these terms, Datok grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for your organization's internal business purposes.
If you provide feedback, you allow Datok to use it without obligation to you, provided we do not identify you publicly without permission.
8. Availability, changes, and suspension
We work to keep the Service reliable but do not guarantee uninterrupted availability. We may update, limit, or discontinue features; perform maintenance; or suspend access when reasonably necessary to prevent harm, address security or legal risk, respond to nonpayment under an applicable order, or enforce these terms. Where practicable, we will provide notice.
9. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available.” Datok disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant that third-party data is complete, current, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Datok will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity arising from the Service. Datok's aggregate liability arising from the Service will not exceed the amount paid for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
11. Termination
You may stop using the Service at any time. Datok may terminate or suspend access for a material breach, security risk, legal requirement, or discontinuation of the Service. Upon termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute provisions—will survive.
12. Governing rules and changes
These terms are governed by the law identified in your applicable order or written agreement with Datok. If there is no separate agreement, governing law and venue will be determined under applicable law. Before filing a formal claim, each party agrees to make a good-faith effort to resolve the issue informally.
We may update these terms to reflect changes to the Service or law. We will post the revised terms and update the date above. Material changes will receive additional notice when required. Continued use after the effective date means you accept the revised terms.
